GEORGE TOWN (Bernama): A butcher escaped the gallows when the High Court on Friday (July 30) acquitted and discharged him on a charge of drug trafficking.
Judge Mohd Radzi Abdul Hamid handed down the decision after finding the prosecution had failed to establish a prima facie case against Sahul Hamid Mohd, 44.
“After evaluating the prosecution’s case, the court found that the prosecution failed to prove that the accused was involved in the possession of the seized drugs and the car that contained the drugs, so the issue of drug distribution did not arise,” he said.
Sahul Hamid was charged with trafficking 59.7084kg of cannabis three years ago.
He was alleged to have committed the offence at Tesco Extra Sembilang parking lot in Seberang Jaya, Seberang Perai Tengah at 3.15pm on Jan 8, 2018.
The charge, under Section 39B(1)(A) of the Dangerous Drugs Act 1952, punishable under Section 39B(2) of the same act, carries the death sentence, or life imprisonment with not less than 15 strokes of the cane, upon conviction.
